According to a report from Joystiq.com, Microsoft has confirmed that their current plan for their upcoming Game Room application will allow them to add titles that correspond to the the ESRB's rating application. In short, Microsoft has decided to allow the ESRB to make sure that any title that would rate above a E10+ rating would not see the light of day.
Microsoft has gone on the record to state that titles featured in the Game Room are "classic arcade and console titles" and that they should be able to add any title without submitting them to the ESRB; that is if the title(s) are currently rated E10+ or lower. Right now there are no plans to release any Game Room titles that are rated Teen or Mature, but Microsoft hopes it will be able resubmit their current application to the ESRB for further review.
We'll have to wait and see if Microsoft will have the permission to release titles above an E10+ rating as the majority of the titles slated for release are classic arcade games.
